on a recent wildfolwing trip some pheasant's got up in front of us when we were having a walk around the area we were still below the high water mark could we have shot them or would we have been breaking the law as one of our group told us we would of been poaching?

You would have still been within the law as regards to seasons, but the emphasis is on your shooting permission. If you are allowed to shoot there with no restrictions on what you shoot you are fine, if youare only allowed to shoot wildfowl then there would have been an issue. Best to check with the landowner and get it in writing for future trips.

Would the ground we owned by the crown?

If so I assume there is an agreement in place to allow you to take wildfowl possibly through a club??

If so the club will have clear rules as to what quarry is legal.

If not through a club but with agreement from the landowner or his agent then you may be OK.

If it was me I would have a word with BASC to get their view.

a quick update

i spoke to BASC today they said it's perfectly legal to shoot pheasant's on the foreshore so long as it's below high water and the bird doesn't fly over any private land and you use non toxic shot
